Terms of Service

The terms that govern your use of WandVideo, an AI video generation platform.

These Terms of Service ("Terms") are a binding agreement between you and WandVideo ("WandVideo", "we", "us"). They govern your access to and use of the website wandvideo.com, our AI video generation services, and any related features (together, the "Service"). By creating an account, purchasing credits, or generating a video, you agree to these Terms and to our Privacy Policy, Acceptable Use Policy and Refund Policy.

1. What WandVideo is

WandVideo is an independent platform that lets you generate short videos from text prompts and images. The videos are produced by third-party AI models (for example models from Kuaishou, Google, MiniMax, Alibaba and ByteDance) that we access through the fal.ai API. WandVideo is not affiliated with, endorsed by, or sponsored by any of these model providers. Model names are used only to identify which model produced your output.

2. Eligibility and accounts

  • You must be at least 18 years old, or the age of majority where you live, to use the Service.
  • You must provide accurate information when you register and keep your login credentials confidential. You are responsible for all activity under your account.
  • One person may hold only one account. We may suspend accounts created to abuse free credits or to evade a ban.

3. Credits and payments

  • Generations are paid for with credits. Credit packs are sold as one-time purchases at the prices shown on the Pricing page. Prices are in US dollars and exclude any taxes that may apply.
  • The number of credits a generation costs depends on the model, duration and resolution you choose and is shown before you confirm. Credits are deducted when a generation is submitted. If the generation fails on our side or on the model provider's side, the credits are automatically returned to your balance.
  • Credits are not money, have no cash value, cannot be transferred, and expire as stated at the time of purchase. Promotional or free credits may expire earlier.
  • Payments are processed by our payment partner. We do not store your full card details.
  • Refunds are handled according to our Refund Policy.

4. Your content

  • Inputs. You keep ownership of the prompts and images you upload ("Inputs"). You grant us a worldwide, non-exclusive licence to process your Inputs solely to provide the Service, including sending them to the model provider that generates your video and running automated safety checks.
  • Outputs. Subject to these Terms and to the extent permitted by law, you own the videos generated for you ("Outputs") and may use them for personal or commercial purposes. Because AI models can produce similar outputs for similar prompts, we cannot guarantee that an Output is unique or that you can claim exclusive rights in it.
  • Your responsibility. You confirm that you have all rights needed to upload your Inputs, including the consent of any real person shown in an uploaded image, and that your Inputs and intended use of the Outputs do not violate any law or the rights of others.
  • Sample gallery. We do not publish your Outputs publicly unless you explicitly opt in.

5. Acceptable use

You must follow our Acceptable Use Policy. In short: no sexual content, no content involving minors, no non-consensual depictions of real people, no graphic violence, no illegal or deceptive content. Prompts and images are screened automatically before generation. Requests that are blocked do not cost credits. Repeated violations lead to suspension without refund of remaining credits.

6. Service availability and changes

  • Model availability, parameters and pricing depend on third-party providers and may change at any time. We may add, update or retire models. Pages marked "coming soon" describe models that are not yet available and only repeat information announced publicly by the provider.
  • We aim for high availability but the Service is provided "as is" and "as available" and may be interrupted for maintenance or reasons outside our control.
  • We may modify the Service or these Terms. Material changes will be announced on the site; continued use after a change means you accept the updated Terms.

7. Intellectual property

The WandVideo name, logo, website design and software are owned by us or our licensors and are protected by intellectual property laws. Except for the rights in Outputs described above, no rights are granted to you.

8. Disclaimers

AI-generated videos can be inaccurate, unexpected or unsuitable for your purpose. You are responsible for reviewing Outputs before you use them. To the maximum extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement.

9. Limitation of liability

To the maximum extent permitted by law, WandVideo will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

10. Indemnity

You agree to indemnify and hold WandVideo harmless from any claims, damages and expenses (including reasonable legal fees) arising from your Inputs, your use of Outputs, or your breach of these Terms.

11. Termination

You may close your account at any time from your dashboard. We may suspend or terminate accounts that breach these Terms. On termination your right to use the Service ends; unused credits are forfeited if the termination is due to your breach.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Delaware, unless applicable consumer law gives you the right to bring claims in your own country.
